SONGGIFT CUSTOMER TERMS

Clear terms for
a personal creation.

These terms apply when SongGift accepts your brief and sends you a secure payment link. They are designed to be read with the accepted brief, confirmed package, price and delivery estimate we send you before payment.

1. Who you are buying from

SongGift is a registered business name of HRAR Appliances Pty Ltd (ABN 33 627 126 667), based in Tasmania, Australia. You can contact us at hello@songgift.com.au.

2. Review before payment

Submitting a song brief is free and does not place an order. Bruce and Ray first review the story, requested timing and package. An order is accepted only when SongGift confirms those details in writing, sends you these terms and a secure Stripe payment link, and Stripe confirms payment.

We may decline a brief before payment if it is unsuitable, cannot be completed responsibly, or cannot be delivered within the requested timeframe.

3. Your SongGift package

Your confirmation will identify the package and any agreed variations. The packages currently available are:

SongGift Memories has limited production places. We confirm timing, visual direction and suitability before payment. Major story changes after approval, extra song-refinement rounds or unusually complex likeness work may require a separate written quote and your agreement.

A version is a different musical interpretation of the same accepted brief. A song-refinement round is one collected request for reasonable changes to a selected version. Corrections to errors introduced by SongGift do not use your song-refinement allowance. A new story direction, substantially new source material or a change outside the accepted brief may require a new quote and your agreement before extra work begins.

SongGift Moments — A$169 including GST: SongGift Moments is A$169 including GST: everything in Plus, including four total song-refinement rounds, plus one chosen song up to five minutes with five pictures total—your photos first, suitable generic pictures from our existing collection, or a mix. Includes basic cropping, gentle movement and fades, a title and dedication, one 1080p landscape MP4 and one separate collected picture-order, crop or text correction round. Especially suited to shorter songs. No newly generated scenes or detailed lyric-by-lyric picture timing is included. Restoration, extra pictures, additional formats or changing the approved song after video assembly require a separate agreed quote. Corrections to our mistakes remain free. We confirm suitability, scope and timing before payment. Please provide only pictures you have permission to use. Existing accepted orders retain their agreed terms.

SongGift Story — A$249 including GST: including Plus song deliverables, one collected lyric review and approval before music, six total collected song-refinement rounds (including the four in Plus) within the agreed brief, and a landscape MP4 of one selected recording up to five minutes with up to ten illustrative still pictures, title or dedication and gentle transitions. One collected picture, title or timing correction round is separate from song refinements. An optional +A$29 including GST option covers up to five suitable, permissioned, ready-to-use personal photographs replacing illustrations within the same ten-picture cap, with basic cropping. Actual additional handling is assessed before a photo charge; restoration, scanning, complicated retouching, more pictures and extra rounds require a separate agreed quote. We confirm suitability, capacity, included scope, any photo charge and delivery timing before payment. Existing accepted orders retain their agreed terms.

Story review process: Please nominate one contact to collect feedback. For Story, we agree the brief, review and approve the lyrics, complete the song refinements, then confirm the chosen recording before making the picture video. The six song-refinement rounds are the total allowance, including the four in Plus; they are not six rounds for each recording. Each round covers one collected batch of changes to one selected recording within the agreed brief. Internal unsuccessful production attempts do not count as customer rounds. Regenerating music can change the voice, melody or arrangement; we cannot promise every musical detail will remain identical. The separate picture-correction round follows the first complete video review. A request to change the confirmed recording or agreed visual direction after picture production starts is assessed for additional work, with any price and timing agreed before that work begins.

Delivery support: Email hello@songgift.com.au for help opening your private gift, downloading the supplied files or accessing your printable lyrics during the 60-day delivery period. This delivery help does not use a creative song-refinement round. New creative changes remain subject to the agreed package allowance or a separate quote. We confirm any extra work, price and effect on timing before starting it. Corrections to mistakes introduced by SongGift are free and do not use your allowance. Download and back up your files before the stated expiry; permanent hosting and replacement access after expiry are not guaranteed. Existing accepted orders retain their agreed terms.

Audio formats: selected recordings are supplied in MP3 and WAV. A WAV file may be prepared from an edited or MP3 source and is not automatically an original lossless master. Converting an MP3 source to WAV does not restore audio detail. Tell us before ordering if you require an original lossless master so we can confirm availability in writing.

4. Price and payment

Prices are in Australian dollars and include any applicable GST unless we state otherwise in writing. Payment is processed by Stripe on a Stripe-hosted checkout page. SongGift does not ask you to send card details by email or message. We begin production only after Stripe confirms payment.

5. Timing and delivery

Your requested date is not guaranteed until SongGift confirms a delivery estimate in writing. For SongGift Memories only, please allow at least five days for video production after the song, visual plan and source materials are approved. This is not a delivery promise for the entire order; we confirm an individual date before payment. You agree to respond within a reasonable time when we ask for clarification, a selection or revision instructions. A delay in your response may move the delivery date.

Completed files are delivered digitally using the contact details connected with the accepted order. Your private delivery link remains available for 60 days from the date we send it. We will state the exact expiry date in the delivery message and aim to send reminders approximately 15 days and 3 days before access ends. Please download and safely back up all included files during that period.

After the expiry date, the private delivery page and its customer download access may be disabled. If you later need replacement access, contact us; we may be able to help if the production files are still retained, but permanent storage and replacement access are not guaranteed.

6. Your brief, photographs and permissions

You keep any rights you already have in stories, original lyrics, photographs and other material you provide. You give SongGift permission to use, edit, crop and adapt that material, and to share it with service providers involved in production and delivery, only as reasonably needed to review the brief, create the SongGift, process payment and deliver the order.

You confirm that you have permission to provide and use the names, stories, lyrics, recordings, photographs and other material in your brief. If an identifiable person appears in a supplied photograph or requested video, you confirm that you have their permission for SongGift to use their image or likeness in an AI-assisted personal video. A parent or legal guardian must authorise use involving a child. Tell us before production if anyone must remain private or be excluded.

AI-assisted video may create, alter or combine people, locations, clothing, objects and events. It may not reproduce a person or factual event exactly. Unless we agree otherwise in writing, created scenes are artistic interpretations inspired by the accepted brief, not documentary footage of events that actually occurred.

7. AI-assisted music, video and your use

Bruce and Ray shape each SongGift using licensed AI-assisted music and video tools together with human creative judgement. SongGift keeps the relevant creation and licence records. AI-assisted outputs may not be unique, and copyright protection can depend on human contribution, the tools used and applicable law.

Before final delivery of an included video, the buyer will have an opportunity to review the overall story and report material errors, unsuitable scenes or an incorrect likeness. Minor variations, lip-sync differences and other normal AI-generation limitations are not necessarily defects. The accepted package or quote will state the included review and song-refinement allowance.

For a completed, paid order, SongGift gives you permission to download, keep and back up the delivered song and video files; share them privately with friends and family; post them on personal, non-monetised social accounts; and play them at private personal occasions.

Commercial, advertising, monetised, broadcast, resale, relicensing or business use requires SongGift's written approval for the specific song and video. You must not register a SongGift in Content ID, a fingerprinting database, copyright registry or collecting society in a way that restricts lawful use of similar AI-assisted material. These terms do not promise exclusive ownership or transfer an underlying third-party tool licence.

8. Cancellations and refunds

If you change your mind before production begins, contact us promptly and we will refund the payment. If production has begun, you may still ask to cancel. We will explain the work completed and provide a reasonable refund for the part of the service not yet performed.

If SongGift cannot complete an accepted order, we will offer an appropriate remedy, which may include completing the service within a reasonable time, supplying a corrected result, or refunding the affected part of the price.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law. Depending on the problem, those rights may include correction, cancellation, a partial or full refund, or compensation.

9. Concerns and disputes

Please contact us promptly at hello@songgift.com.au with your order details and the outcome you are seeking. We will review the concern in good faith and aim to respond within five business days. These terms are governed by the laws applying in Tasmania, Australia, without limiting any rights you have under applicable consumer law.

10. Privacy and updates

We use order information to assess your brief, communicate with you, create and deliver the SongGift, keep business and licence records, prevent misuse and meet legal obligations. Stripe handles payment information under its own privacy terms. We do not sell your brief or payment information.

The terms accepted at checkout continue to apply to that order. If we update these terms later, the update will not retrospectively reduce your rights for an existing paid order.
